Section 111 of the Medicare, Medicaid, & SCHIP Extension Act of 2007 (MMSEA) amended the Medicare Secondary Payer (MSP) statute
Effective January 1, 2010, mandatory reporting will be required on all Liability, Workers’ Compensation and Accident & Health claims that involve Medicare beneficiaries. Reporting will be required to be submitted on a quarterly basis and non-compliance for late or flawed reporting is subject to a penalty of $1,000 per day, per claim.
Quarterly reporting is conducted by the Responsible Reporting Entities (RRE) through their designated reporting agent. Parties who are responsible for funding payments on claims, including nonsubscribers who pay claims within their deductible, must register as the RRE and designate their reporting agent by September 30, 2009. Registration is conducted online via Centers for Medicare and Medicaid Services (CMS) website at www.Section111.cms.hhs.gov
Medicare Set Aside (MSA) is not a requirement under Section 111 but will be considered on a case by case basis in response to the MSP statute.
